1. Introduction
These Terms and Conditions govern the sale of livestock (specifically Appenzeller Spitzhauben poultry) by 
t/a Appenzeller UK (“the Seller”, “we”, “us”) to the customer (“the Buyer”, “you”) via appenzeller.co.uk. By placing an order, you agree to be bound by these terms.
2. Collection Only Policy
- No Delivery: We do not offer delivery or courier services for live birds.
- Collection Point: All orders must be collected from our premises at Croft Cottage, Blithbury, Rugeley WS15 3JD, by prior appointment only.
- Risk Transfer: Legally, “delivery” is deemed complete, and all risk for the welfare and safety of the livestock passes to the Buyer, the moment the birds are loaded into the Buyer’s vehicle.
3. Livestock Health and Quality
- Satisfactory Quality: We warrant that at the time of collection, all birds are of “satisfactory quality” and “fit for purpose” as described on our website.
- Health Check: We invite all Buyers to inspect their birds at the point of collection. Once the birds leave our premises, we cannot be held liable for injury or illness caused by transport stress or integration into new flocks.
- Warranty Window: Buyers must report any health concerns present at the time of sale within 48 hours of collection.
4. Biosecurity and Transport
- Buyer Responsibility: It is the Buyer’s responsibility to provide a suitable, well-ventilated, and secure crate or box for transport.
- Farm Biosecurity: To protect our flock, Buyers must follow all on-site biosecurity instructions provided at the time of collection.
5. Cancellations and Refunds
- Perishable Goods: Under UK law, live animals are considered “perishable” or time-sensitive goods. The standard 14-day “cooling-off” period for online sales ends once the birds have been collected.
- Refunds: Refunds are only issued if the birds are proven to be of unsatisfactory health at the time of sale, subject to our 48-hour notification window.
- Non-Collection: If an order is not collected within 7 days of the agreed date, we reserve the right to cancel the order and retain a 20% restocking fee to cover feed and housing costs.
6. Limitation of Liability
The Seller’s total liability for any claim shall not exceed the purchase price of the birds in question.
